AA-US Airways Merger Could Happen Next Month

American Airlines and US Airways could agree to merge as soon as early next month, creating the world's largest airline, company and union insiders say.

Unions are quietly negotiating new deals with a combined company, and if they and the airlines can agree on sticky issues such as seniority, a merger could be put on the fast track.

The board of directors of American's parent company, AMR Corp., has scheduled a meeting Jan. 9 and could vote on a merger then, NBC 5 has learned.

People involved in the process stressed that many difficult details still must be ironed out before a merger vote can take place.

Company and union officials did not want to be quoted by name because of the sensitivity of the ongoing discussions.

The judge in charge of American's bankruptcy and the influential committee of creditors also would have to sign off on a deal.

Leaders of the Allied Pilots Association have huddled in their Fort Worth headquarters since last week. One union official said the APA is "not close" to an agreement but talks are expected to continue Friday and into the weekend.

American's three major unions -- representing pilots, flight attendants, and ground workers -- have already signed new labor agreements with the bankrupt airline. The talks now under way essentially involve new contracts with a merged company.

Combining workforces is full of potential pitfalls for each company. US Airways has not successfully combined labor groups since it merged with America West seven years ago. A merger with American could allow it to solve its current labor issues all at once -- or merely add to their complexity.

A merger would likely mean thousands of American employees would be pushed lower on the seniority list, but the value of a new deal could be a huge incentive. American pilots, for example, could add $100 million per year to their overall compensation, union insiders say.

APA President Keith Wilson sent a letter to pilots Thursday evening, saying if the union does not agree to a new plan, there would likely not be a merger until after American exits bankruptcy.

Wilson acknowledged support for a merger is not unanimous among union leaders or airline executives.

"AMR management has not embraced the concept of expediting a merger before restructuring concludes and clearly wants to retain control of the corporation," he wrote.

Wilson also argued that an agreement on seniority before a possible merger should not be a requirement.

"No legal mechanism exists that would allow union-represented employees to interfere with a major transaction such as a merger," he said.

It's unclear who would lead a combined airline. But analysts say a merger would likely push out American's top executive, Tom Horton, who has led the airline since it declared bankruptcy last November.

US Airways' executives have said if they win control, they would use American's brand name and keep its headquarters in Fort Worth.

Dallas police are searching for a burglar who is breaking into homes right under their noses.

The break-ins occurred on Christmas Eve just a couple of blocks from Dallas police headquarters.

"It's kind of wild that on Christmas Eve, someone would come into your house and steal what you've earned," Billy MacLeod said.

His home on Akard Street was one of at least two broken into in the Cedars neighborhood. In both cases, the burglar kicked in the front glass door.

At MacLeod's house, the thieves stole most of his Christmas presents, along with small electronics and jewelry.

"They came in, they opened up all the presents," he said. "They took what they wanted. They probably weren't in here very long."

But the burglar didn't steal his family's Christmas spirit, MacLeod said.

"We weren't going to let a thief take our Christmas, so what we did was, we cleaned up after the police left. We boarded the house up. We went out shopping for each other," he said. "We wrapped our presents in secret. We still had our Christmas morning."

But what the burglar left behind has the radio salesman thinking more like a detective.

"I don't know about being Colombo or Matlock or Perry Mason, but I did find a clue, and I think it points directly to who did this," he said.

The burglar left behind a delivery invoice printed on the morning of Dec. 24. Neighbors also report seeing a white delivery truck in front of his house.

NBC 5 is not releasing the name of the company to allow police time to investigate the invoice.

MacLeod said he found it next to a box of chocolates that had been eaten and some wrapping paper.

The other victim said the burglar opened a bottle of apple juice at her house, as well as a bottle of liquor, and appears to have made a mixed drink while rummaging through her house.

A man was shoved onto subway train tracks and killed Thursday evening in New York City, in the second such fatal subway push attack in the city in a month.

Police are looking for a woman who was seen mumbling to herself before she allegedly pushed the unsuspecting man to his death in front of an oncoming No. 7 train at a Queens subway station Thursday evening, police said.

The man was standing on the northbound platform of the 40th Street and Queens Boulevard elevated train when police say the woman walked up behind him and pushed him onto the tracks. Witnesses told police the man had his back to the woman and didn't appear to notice her. No words were exchanged.

The man died at the scene. His identity has not been released.

Witnesses told police the female suspect had been walking back and forth on the platform and talking to herself before sitting down, alone, on a wooden bench near the north end of the walkway. When the train pulled into the station shortly after 8 p.m., the woman got up off the bench and pushed the man, according to witness statements.

The suspect then fled the platform, running down a flight of stairs to the turnstile area and down a second flight to Queens Boulevard. It's unknown where she went from there. Police released surveillance video of her running onto the street.

The suspect is described as being a heavyset woman about 5 feet 5 inches tall with brown or blond hair. She was wearing a white and gray ski jacket and Nike sneakers at the time of the incident.

"I heard it. One of my customers was on train and heard it going over body," Jiovanni Briones, who works near the scene, told NBC 4 New York.

Earlier this month, Naeem Davis, a 30-year-old deli worker, was arrested and charged with second-degree murder for allegedly pushing another man off a Midtown subway platform to his death.

Ki-Suk Han, 58, was stuck by a southbound Q train after being pushed off the platform at the 49th Street station Dec. 3.

A man gunned down Thursday in Chicago marked what police say is the city's 500th homicide of the year. It's a dubious distinction that hasn't occurred since 2008, when the city ended the year with 512 murders.

Chicago surpassed 2011's 435 murder total in October.

Police are releasing few details about the shooting, which happened around 9 p.m. on the city's west side. The victim was taken to Stroger Hospital, where he died.

Police said Chicago's 499th homicide victim was a man who died after he was shot at least four times – including in the face and chest – in a Gage Park neighborhood alley Wednesday night on the Southwest Side.

Frederico Martinez died from gunshot wounds he suffered near his home, according to the Cook County Medical Examiner's office.

Police said the 32-year-old Martinez was standing with a female in an alleyway down the block from his home when a light-colored pick-up truck approached and somebody inside opened fire on the two just before 10 p.m.

Martinez was shot in the face, chest and both arms and was taken to Mount Sinai Hospital, where he died at 10:41 p.m., authorities said.

Behind the troubling statistics, flashing lights and crime tape, communities throughout the city are searching for solutions.

"There's no magic spell that can end it. It's a matter of people and neighborhoods coming together and deciding that it's not going to happen," said neighbor Robert Grider.

Larry Pickens, who is running in the special election to replace Jesse Jackson Jr. in his now vacated 2nd Congressional seat, offered a few suggestions Thursday: "Teaching our young people alternative dispute resolution, non-violent strategies for addressing conflict and getting guns off the street."

Three police officers were injured after a suspect grabbed a gun and opened fire inside a New Jersey police station early Friday, police said.

Police shot the gunman dead during the confrontation, Gloucester Township police said.

The incident happened around 5:45 a.m. when a suspect that had been brought in for a domestic incident got into a confrontation with officers, police said.

"A violent struggle occurred while the suspect was being processed," Gloucester Township Deputy Chief David Harkins said.

The suspect then grabbed a gun and opened fire.

One of the officers was shot below his bulletproof vest, NBC 10 Philadelphia reported. He underwent surgery at Cooper University hospital and is now listed in stable condition. A spokesperson for the hospital says that there were several puncture wounds in the officer's vest.

The other two officers, a male and female, were treated for graze wounds and are set to be discharged Friday morning.

Gloucester Township is about 15 miles southeast of Philadelphia.

Fort Worth police ended a standoff peacefully Friday morning after a barricaded man refused to come out of his apartment.

Police said the man fired several shots into the air after an argument with another man in an apartment complex near Gunnison Trail and Phoenix Street.

A police officer nearby tried to stop the man, but he ran into his apartment.

The man refused to come out and police SWAT teams were called out. As a precaution, nearby neighbors were evacuated to a safer location.

Shortly before 7 a.m., police made contact with the man and took him into custody without further incident.

Residents of the complex returned to their homes a short time later.

Friday morning, Dallas police are looking for the gunman who shot and killed Lorenzo Wilson Thursday night.

Police said Wilson, 58, opened the front door to his Brackins Village apartment at about 10:45  p.m. Thursday and was met with gunfire.

Officers responded to Monaghan Court and discovered Wilson on the floor, clinging to life. Paramedics rushed him to Methodist Hospital where he died a short time after the shooting.

His wife, who was home at the time, escaped without any injuries, police said.

The person who pulled the trigger got away. Officers scoured the area searching for any witnesses who could help find the killer. 

So far, no arrests have been made and a motive has not been determined.

A large warehouse in Grapevine caught fire Friday morning along the 600-block of Industrial Boulevard.

The 2-alarm fire was first reported at about 8:30 a.m. at Wrico Stamping when smoke started filling the building.

Employees were evacuated and, as firefighters arrived, were moved to a bus and triage area where anyone overcome by smoke could be treated for their injury.

Firefighters are taking special precautions due to chemicals at the site.

So far, it is not known what started the fire and if there are any injuries.

NBC 5 has crews at the scene and we'll update this story with more information as soon as it's available.  As this story is developing, elements may change.

Baby Toys Recalled Due to Choking Hazard

The U.S. Consumer Product Safety Commission is recalling more than 45,000 Sassy and Carter's-brand Hug N' Tug Baby Toys due to a choking hazard.

The toys, aimed at infants, have beads inside the clear plastic sphere at the center of the toys that can be released, posing a choking hazard to young children.

There have been 12 reports of released beads with the Sassy toys. No incidents have been reported with the Carter's-branded toys. No injuries have been reported.

The recalled toys have the face of either a puppy or monkey.

Recalled styles include: Sassy Hug N' Tug Puppy, model #80213; Sassy Hug N' Tug Monkey model #80214 and Carter's-branded Hug N' Tug Monkey, models #61083 that were sold on a blue packaging card and #61540 sold on a grey packaging card.

Sassy-branded toys have "Sassy" written on the back of the character's head,  Carter's-branded toys have "Carter's" written on the back of the character's head.

The recalled Sassy-brand toys were sold between July 2012 and October 2012 at Toys R Us, Target and online retailers such as Amazon.com and Carters.com. The Carter's-branded recalled toys were sold in Carter's retail stores.

Consumers should take the toys away from children and contact Sassy to return the toy for a free replacement at 800-323-6336. You can also visit the company's website at www.sassybaby.com and visit the Product Recall Information link.

A Plano kindergartner is making a big contribution to the police department's annual Christmas Cops gift drive.

Pari Kuechenmeister said she was blown away when her son announced he'd like to raise money to collect toys for kids in need.

"It was all his idea," she said. "He said, 'I saw that they're collecting toys for kids, and I want to do what I can to help.'"

Six-year-old Alex had an idea for a cold-weather twist on a traditional fundraising technique, and the Kuechenmeister family set up a hot chocolate station near their home.

They live in Deerfield, a Plano neighborhood famous for over-the-top decorations that draws huge holiday crowds of gawkers.

Their hot chocolate stand paid off in a big way -- to the tune of more than $500.

"The amount of money he's raised would be amazing, no matter who it came from, a corporation or individual donation," said Christmas Cops organizer and former Plano Capt. Harry Manning.

"Coming from someone of his age just makes it that much more special," he added.

Alex even took it one step further, calling the department to ask which items were most needed or highly requested, Manning said.

The 6-year-old ended up bringing in some big ticket items, such as a bicycle and video games.

His parents say they've always tried to instill the gift of giving in their children, and Alex's take on Christmas is refreshingly uncomplicated.

"I wanted to give presents to kids in need," he said.

Manning said the boy's donation will pay it forward more than many can understand.

"He's the best little elf ever," he said.

Christmas Cops helps 200 families, including 600 to 700 children.

Plano police will pass out the collected boxes and gifts on Saturday.

Police departments everywhere say crimes such as burglary rise during the holidays.

Home and car burglaries tend to increase as thieves look to profit from newly purchased gifts.

Burglars also target home deliveries. UPS, FedEx even the U.S. Postal Service all get more complaints of theft after leaving gifts at unattended homes.

Thieves know to follow delivery trucks and wait, which is what happened at Alicia Vaughn's Oak Cliff home.

A woman walked to her porch and stole a box of gifts seconds after UPS delivered the package.

"Video footage showed them driving in front of the house back and forth two times, and as soon as the UPS guy drove off, they came back again drove up and backed into the driveway," Vaughn said.

The theft happened despite Vaughn's sign in her porch window that warns thieves they are under video surveillance.

"I've uploaded the videos on YouTube, onto Facebook," she said. "I notified the news station, and I want these people to know I see you and I know what you've done and you're not going to get away with it."

UPS trains delivery personnel to conceal packages left at home, especially at this time of year.

"Unfortunately theft at this time of year happens every year," UPS spokeswoman Natalie Godwin said. "We always receive these complaints at Christmas."

The volume of deliveries creates opportunity. Thursday is the busiest day of the year for UPS, which will make 28 million deliveries on Thursday alone -- 300 packages per second.

"They have no idea what they have, and it may not mean anything to them," Vaughn said. "They just want to pawn it or make some money, you know. It's meaningless it's an easy crime."

UPS has a program to ensure delivery when customers want it, either by time or adult signature,

Vaughn said she would look into it next time, even though she has been getting gift deliveries the same way for 14 years.

An emotional interfaith service in Fort Worth Thursday night brought together people of different religions united in their grief over the school shooting in Connecticut.

The service at First United Methodist Church downtown was called Candles for Connecticut.

Mayor Betsy Price sent the city's condolences to Newtown.

"Please know our thoughts and prayers are with you tonight and every day going forward," she said.

Police Chief Jeffrey Halstead represented first responders. Officers and firefighters filled the first pews.

An imam from the Islamic Association of Tarrant County got emotional.

"It doesn't have to be a Muslim or a Christian or a Jewish or any other faith," said Imam Moujahed Bakash. "As a human issue, the picture will never go away from my head."

He said he can't stop imagining the Christmas gifts the young victims will never receive.

The pastor at Fort Worth's Wedgwood Baptist Church, the site of a massacre in 1999, spoke from his heart.

"Deliver us from our nonchalance from those hundreds of thousands -- millions -- who suffer in the darkness of mental illness with no help and no hope," he said.

The names of the 27 victims were read as candles were lit one at a time.

The bells at First Methodist Church and several other churches will ring at 8:30 a.m. Friday to remember the massacre victims.

Coppell police are asking for help identifying a thief targeting day care parking lots.

In the most recent case, the thief stole the purse of an unsuspecting mother Dec. 12 at a Montessori School in Coppell. Investigators said the thief stole her purse from her car during the few minutes she was inside picking up her child.

Surveillance video from a Lewisville Target shows a man trying to buy $2,000 worth of gift cards with the victim's credit card.

"He's very well-dressed -- has a cardigan sweater on and looks like he would blend in with everyone else," Detective Anthony Maurer said. "He doesn't look like a bad guy."

The man left when a manager asked to see his identification.

"I think he has probably struck many times since this time," Maurer said. "It's probably something he does on a daily basis."

The crook left the Coppell day care on Dec. 12 in a newer model, burgundy Dodge double-cab pickup with no license plates and headed to a Target in Plano.

Police Chiefs Mull Distracted-Driving Policies

An NBC 5 investigation into the distractions caused by police computers in cars is now gaining national attention. And a prominent group of police leaders is pledging new nationwide guidelines to help police prevent crashes caused by officers driving distracted.

In the last six months, the NBC 5 Investigates team reported on crashes caused by police officers who are looking at their computers instead of the road.

After the original stories aired in Dallas-Fort Worth, NBC5 Investigates worked with "NBC Nightly News" to produce a national story using videos and interviews from the Texas reports.

The story gained the attention of the International Association of Chiefs of Police, the world's largest organization of police leaders. The IACP recently sent the story to the state police commanders in all 50 states.

The Missouri State Highway Patrol has made the story mandatory viewing in safety training.

"I thought it was extremely important for our people to view it," Sgt. William Lowe said.

All Missouri troopers have to sign off that they've watched it.

"Showing this and having the other troopers see this footage and the video of these crashes, I think they were pretty taken aback by what can happen in the blink of an eye," Lowe said.

Col. Mike Edmonson, superintendent of the Louisiana State Police and the head of IACP's division of state police, is now leading a nationwide effort to rethink the way computers are used in police cars.

"It's not OK when we know it's an unsafe situation, when we know that it's not the right thing," he said. "We've got to be leaders and step up. We got to be different. We got to change the culture and say, 'You know what? Not acceptable.' We got to fix it."

Working with fellow IACP members, Edmonson plans to create policy guidelines that any police department in the world could use.

The challenge is to balance the benefits and dangers of the computers, cameras, phones, radios and scanners that have turned police cars into offices on wheels where driving can seem almost secondary.

"I think we're going to look at what's going on around the country that's successful," Edmonson said. "Whether we look at Fort Worth and what they've done successfully, I think you have to take those things -- those are templates that can be used to move forward."

Fort Worth's new computer policy, which was implemented after NBC 5 started investigating, gives officers flexibility to key in simple, one-touch responses but prevents them from typing messages while the car is moving.

Edmonson said typing and driving is not only dangerous, but it also creates a double standard in because police are telling the rest of us not to text and drive.

"You pull up alongside a police officer, there they are, texting away," he said. "Well, what makes it right? The bottom line, it doesn't make it right."

At a meeting in San Antonio last week, the Texas Police Chiefs Association told NBC 5 Investigates that it also plans to study the issue in its safety committee.

It could result in the publication of papers and study materials, the development of training and model policies. The group says it is very early in the process.

The Texas Police Chiefs Association does not have a model policy to guide Texas police departments. Neither does the International Association of Chiefs of Police.

A small group of IACP member state police commanders from around the country met last weekend in Louisiana to start looking closer at the issue. They plan to meet again in March and develop recommendations that give police chiefs everywhere a starting point to deal with this.

They recognize every police department has different technology and different challenges, but they want to make a strong statement about the dangers of distracted driving and give some general guidelines.

Broward Murder Suspect Eludes Authorities

A man wanted in connection with a Broward County murder is on the run again. Felipe Alex Torrealba, 26, fled authorities Thursday night before they arrived at the southwest Florida home where he was staying, according to the Broward Sheriff's Office. He is believed to have fled from the home in Lehigh Acres near Fort Myers with his 22-year-old girlfriend, Dayana Garcia, a 5-year-old boy and a 4-month-old girl, the BSO said.

A suspect in a Broward County murder was taken into custody in Fort Myers Thursday, a U.S. Marshals Service spokesman said.

Felipe Alex Torrealba, one of the agency's 15 most wanted fugitives, is being transported to the Broward County Jail Thursday night, spokesman Barry Golden said.

Earlier this year the Broward Sheriff's Office called Torrealba a suspect in the murder of Kris Smalls, 42, of Weston, who was found dead in his SUV in March one week after he was reported missing.

Two handguns and about $15,000 in cash as well as a pair of binoculars and a wig were found inside the two-story townhouse where Torrealba was hiding as authorities arrested him, the U.S. Marshals said in a statement.

A rental vehicle with two different Texas license plates, which was parked outside the townhouse, is believed to be the vehicle that Torrealba used to elude law enforcment, the agency said.

Torrealba's attorney, Jim Lewis, said he has not heard from him since February.

"These are some very serious allegations, and when he's returned here to Broward County I hope to sit down and talk with him, and get to the bottom of them, and find out what the truth is," Lewis said Thursday night.

Torrealba was also wanted in connection with a January incident in which he was shot in the ear by a Sweetwater Police officer as he fled a traffic stop.

A week after a shooting rampage in a Newtown elementary school left 27 people dead -- including 20 first graders and six teachers -- First Lady Michelle Obama penned an open letter to the residents of Newtown, which ran in the Hartford Courant under the title 'Holding You In Our Hearts.'

In the letter, Obama said she was inspired by the heroism of first responders, teachers and children in the school, and proud of the support the entire nation has shown over the past week. And she promised that President Obama will 'use the powers of his office' to find ways to prevent such tragedies in the future.

Over the past week, we as Americans have been united in our grief as Newtown has laid to rest so many beautiful, innocent children, along with the heroic educators who worked every day to help them achieve their dreams.

As a mother of two young daughters, my heart aches for you and your families. Like so many Americans, I wish there were something - anything - I could do or say to ease your anguish.

But I know that I cannot begin to imagine the depths of your grief. I know that for many of you, the pain you are enduring right now seems unbearable; and many of you may be asking yourselves, how can we go on - as families and as a community?

Over the past week, I have been awed and inspired by Newtown's heroes: the first responders who risked their lives at a moment's notice; the educators whose devotion to their students shone brightest in one of our nation's darkest hours; the children who comforted each other despite their fear; the families coming together to support each other as they grieve.

And I am so proud of the outpouring of love and support that has come from every corner of America: from first responders from neighboring cities rushing to help however they could; from people in Cleveland and Charlotte and Juneau and so many other communities joining together to honor Newtown with their thoughts and prayers; and in living rooms and houses of worship and the halls of our government, where we are beginning to have those difficult conversations about how we can build a safer, more peaceful tomorrow for all our children.

And I want you to know that this is just the beginning. As my husband has said, in the coming weeks, he will use all the powers of his office to engage citizens from across this country to find ways to prevent tragedies like this one. And please know that every minute of every day, we are thinking of you, and praying for you, and holding you and your families in our hearts as you begin the slow and wrenching work of healing and moving forward.

The driver of a street sweeper is in the hospital after a crash in Grapevine Friday morning.

Grapevine firefighters responded to the crash at northbound state Highway 121 ramp at William D. Tate Avenue at about 12:30 a.m.

The street sweeper was found upside down near Mustang Drive. The driver was pinned inside.

A medical helicopter was called and airlifted the man to the hospital.

Police say the man was in the street sweeper was working along the ramp when he veered off into the grass and the sweeper flipped.

The driver is in stable condition.

The investigation is ongoing.

The grandparents of one of the victims in the Sandy Hook School shooting lives in Delaware County. This morning the community there came together to remember the 20 children and six adults who lost their lives.

Church bells across the country rang 26 times Friday morning—one for each of the victims killed at Sandy Hook Elementary School —to mark the one-week anniversary of the Connecticut shootings.

Gov. Dannel P. Malloy gathered in Newtown with other officials on the steps of the town hall where a bell chimed for each victim, whose name was also read. Five more shooting victims, including three children, were to be buried later in the day.

Malloy requested participation in the bell-ringing earlier this week from all houses of worship and buildings equipped to carry out the symbolic gesture. He also requested Monday a statewide moment of silence at 9:30 a.m. ET, "exactly one week after the horror began to unfold."

Governors from Louisiana to Hawaii to Illinois joined Malloy's call for a moment to remember the 20 schoolchildren and six faculty members killed in one of the deadliest school shootings in U.S. history.

The federal government participated as well, with President Obama observing the solemn 9:30 a.m. occasion at the White House. In the immediate aftermath of the Newtown tragedy, Obama vowed "meaningful action" and announced Vice President Joe Biden would lead a group to come up with "concrete proposals" to reduce gun violence by the end of January. Obama said in a web video Friday he was encouraged by a "We the People" petition posted on the White House website calling for more gun control. "We hear you," he told signers of the petition, which has amassed 200,000 supporters. The National Rifle Association, which has been largely silent since the tragedy, was to hold a press conference later in the day. The group promised "meaningful contributions to help make sure this never happens again."

Secretary of Education Arne Duncan, meanwhile, marked Friday's moment of silence at an elementary school in Washington D.C., where he was scheduled to speak at a school safety forum. His visit to Neval Thomas Elementary School is his first public appearance since the shooting last week.

A group from the technology world planned an Internet-based moment of silence. By Thursday evening, more than 150,000 people had signed a pledge to participate in a "five minute pause from all online activity" organized by Nick Grossman, an activist at Union Square Ventures, and the team at the activist site, Causes.com.

A companion website, webmomentofsilence.org, offered instructions on temporarily blacking out websites to "help bring focus to the events at Sandy Hook and the broader issue of gun violence in America."

The website said that participation did not represent any political agenda and that organizers were hoping to remember the victims and "spark an ongoing productive conversation."

Huffington Post, ESPN, Foursquare, TechCrunch, AOL, Gilt and Adobe were among the sites that participated in the online moment of silence, according to Ad Week.

The National Council of Churches told NBC News that many of its 100,000 congregations were planning to sound their bells Friday morning and those without bells were planning to honor the victims in other ways.

Susan Marie Smith, a rector at St. Albans Episcopal Church in Bexley, Ohio told NBC News that her church was planning a morning fast and 20 minutes of prayer "to share the burden of our brothers and sisters in Connecticut."

Back in Newtown, funerals will continue for a fifth consecutive day. Three more children and two school staffers will be buried. They include: 6-year-old Olivia Engel; 6-year-old Dylan Hockley; 7-year-old Grace McDonnell; behavioral therapist Rachel D'Avino, 29; and school psychologist Mary Sherlach, 56.

On Thursday five children were laid to rest as well as a Sandy Hook teacher and Nancy Lanza, the mother of gunman Adam Lanza who fatally shot her before ambushing Sandy Hook Elementary School and taking his own life.

Grand Prairie Hospital Now Medicare-Certified

For more than a decade, Grand Prairie was the largest city in the United States without an acute care hospital, but now has a hospital certified for Medicare and Medicaid.

Texas General Hospital, which opened in January near Jefferson Street and Great Southwest Parkway, is now Medicare- and Medicaid-certified.

Hasan Hashmi, hospital chairman, said about 40 percent of the hospital's volume is Medicare and Medicaid patients. Until it was certified, Texas General Hospital provided many of the services for free.

Councilman Mark Hepworth said the city has needed such a facility for years.

"Forever, we've had the title -- and I think it's been 10 or 15 years -- 'the largest city in America without a hospital,'" he said.

Brittany Danielle White said she rushed to the hospital on Wednesday after waking up with unexpected aches. She said living just five minutes from the hospital paid off that day.

"I'm blessed to have a hospital nearby, because I never know what can happen," she said. "I didn't expect any chest pains, so I'm really happy that it was nearby."

Hashmi said the hospital is growing quickly.

"We started off by seeing three or four patients in a 24-hour period," he said. "Now we see about 30 to 40 patients in a 24-hour period in our emergency room. Our operating room volume was about two to three a week. Now, it is over 30 a week."

With about 7,500 patients seen to-date, hospital officials said they are looking forward to an even busier year in 2013.

The hospital is preparing to launch its emergency services in January, adding at least 100 new jobs and providing faster response times in cases of emergency throughout the city. The hospital has hired 175 people during the past year, with more than 150 physicians on staff.

12-Year-Old Recovering From Cardiac Arrest

Five months after her school coach used an AED to save her life, a Frisco 12-year-old is thriving. Her parents have a message for all schools and families.

12-year-old Kylee Shea collapsed in the hallway at school and her coaches Brent Reese and Kristen Goodgion saved her with an automated external defibrillator.

Middle school students in Frisco are learning CPR and how to use a defibrillator as part of an expanded CPR awareness curriculum.

The curriculum gives every sixth-grader in the district hands-on CPR training. It costs less than $10,000 to implement at the district's middle schools.

"If you don't know how to do it and there's somebody who needs it, they can possibly die," sixth-grader Ellee Edgar said.

Last year, seventh-grader Kylee Shea collapsed while walking to gym class after her heart stopped beating.

Her coaches, Kristen Goodgion and Brent Reeese, revived her by performing CPR and using a defibrillator.

"It can't just happen to an adult or to a student running -- it can happen to anybody, anytime," Kylee said.

Since her collapse, the school's coaches and Kylee's mother have been crucial in creating and championing the training.

"That was the biggest driving force is we need to get the word out," Goodgion said. "We need to get everybody prepared to do what they need to do."

Seventh- and eighth-graders in physical education classes will also receive the training.

"It's amazing, because two ordinary people can do it," Kylee said. "It's not just coaches. Everybody can do it."

Police and prosecutors met today to discuss the case.

The Irving Police Department on Thursday released two 911 calls and a dashboard-camera video of the fatal one-car crash scene involving Dallas Cowboys players Josh Brent and Jerry Brown Jr.

Brown was killed in the crash, and Brent was arrested and charged with intoxication manslaughter.

In the 911 calls, two different callers report an upside-down vehicle on the frontage road to State Highway 114 near Rochelle and O'Connor roads.

One of the callers reported seeing smoke coming from the vehicle, and the other said the car was on fire.

In the short video, Brent's car can be seen upside down in the roadway. Video of other activity at the crash site was not released.

Brown remembered at vigil in hometown

A memorial was held Thursday evening in St. Louis at Brown's former high school to honor the athlete.

Three dozen people holding candles and pictures talked outside Vashon High School about their memories of Brown.

Brown's mother, Stacey Jackson, said she had spoken to Brent and forgives him.

"I talked to Josh today before we came to the vigil, and I just told him to keep his head up; we're praying for him," she said. "And I still love him. He can call me at four in the morning; he can call me at twelve crying -- I don't care, because Jerry loved him like a brother."

Brent is just like one of her sons, she said.

"It was an accident. We were all young once. We've all done something stupid; we've all regretted what we've done, but we're here to live and see another day," she said. "Jerry's accident was God's way to tell us it was time for his servant to come home. And then Josh -- to get from this, he needs to go out and teach other people and reach other players and let them know never be ashamed to call and ask for a ride. Never be embarrassed, because that's what that service is there for."

Prosecutor expects grand jury to hear case next month

Dallas County Assistant District Attorney Harris Heath said Thursday he is confident the intoxication-manslaughter case will go to trial.

"The fact that Mr. Brent is a Dallas Cowboy or any attention this case has gotten -- we're not going to treat it any differently," he said.

Heath, whom Irving police briefed on the case, said he would look at all the factors, including evidence from the scene, such as sobriety tests.

The day of the crash, Irving police said Brent was arrested after failing a field sobriety test.

Exclusive police documents obtained by NBC 5 show that Brent failed tests such as the walk-and-turn, one-leg stand and visual sobriety tests that required him to follow light stimulus with his eyes. According to the documents, the responding officer said Brent "could not stand without swaying and following the green light stimulus that I was using. Mr. Price-Brent even caught himself swaying."

Heath said he expects a grand jury to take the case by January.

"Josh ought to get the same fair shake from the system that anybody else gets," said George Milner, Brent's attorney.

Brent is free on $500,000 bail.

Whooping Cough Cases on Rise

A student at Nolan Catholic High School in Fort Worth has been diagnosed with whooping cough.

North Texas doctors are seeing an uptick in cases of pertussis, which is more commonly known as whooping cough.

So far this year in Tarrant County, 135 cases have been reported.

A student at Nolan Catholic High School in Fort Worth is the latest case. The school sent a letter home to parents telling them of the case and to monitor their children.

Administrators told NBC 5 that the sick student is not in school at this time.

Dr. Jeffrey Kahn, the director of infectious diseases at Children's Medical Center in Dallas, said the hospital saw 14 cases in all of 2011 but had 113 cases this year through November.

Kahn said younger children -- infants to six months old -- are hit the hardest. Even though the children could have already started their pertussis shots, their immune systems aren't strong enough to fight the highly contagious cough, he said.

Children usually contract the cough from family members, Kahn said.

"Basically, all the cases that we've seen here -- very young children -- there's a history of someone in the household who has had a long chronic cough and they don't recognize that cough as being pertussis," he said.

The cough is treated with an antibiotics regiment, Kahn said.

A Dallas artist is offering a reward for the safe return of two works of art stolen while on display at a gallery earlier this week.

Two of the smaller pieces in Rolondo Diaz's current collection on display at the Janette Kennedy Gallery at South Side on Lamar were stolen Tuesday night.

"It's not even so much the stealing of the work of art -- even though I haven't had that happen to me in the past -- it's the fact that what they took is very personal," he said.

Diaz said the mixed-media pieces have a special significance -- they are part of a collection created to honor his brother, Christian, who recently died of leukemia.

"The pieces that were stolen actually had photographs of me and my brother as children, just like this like here -- my favorite photograph from Havana," he said while pointing to another piece on display.

The building's surveillance video is being checked for clues.

The Cuban-American artist incorporated snapshots and other childhood memories on many of the pieces in his current collection at the JK Gallery.

"I am inspired by all things in life," Diaz said. "I believe that art is the expression of life and, in this particular, the show was definitely inspired by the struggles I saw my brother go through for two and a half years."

Diaz said he and his brother always shared a special bond and he wants the paintings back -- no questions asked.

This is the 10th year for his annual exhibition at the gallery, which continues through Dec. 26.

Man Attempts 3 Failed Carjackings in Same Parking Lot

An unknown man attempted to carjack three different victims in the same shopping center parking lot in southern California on Thursday, officials said.

According to police, the carjacking attempts happened around 2:50 p.m. in the parking lot of a Target store in Oceanside, Calif.

In the first attempt, the suspect allegedly approached a woman as she was exiting her car. He showed her what she believed was a knife and ordered her back into the vehicle. She got inside and drove away, leaving the suspect behind, police said.

The man then immediately approached another woman exiting her car in the lot. Police said he brandished a handgun and told her to get back inside her car.

The victim ignored the suspect and ran into the Target store to report the attempted carjacking.

Police said the man then approached a third woman in the same parking lot who was getting out of her car. He attempted to steal her vehicle at gunpoint, ordering her to remove the club device from her steering wheel and leave her keys in the car.

The victim complied, removed the club and left the keys in the car. Before walking away, she activated some sort of kill-switch that disabled the ignition.

The man tried to start the car but instead became locked inside the vehicle.

He smashed through a window to get out and fled the scene, police said.

None of the three victims was injured.

Police searched the area for the suspect but were unable to immediately locate him. He remains outstanding.

Officers describe the suspect as a white male in his 40s to 60s with a thin build and "leathery" skin. He was carrying a black backpack and was described by witnesses as transient in his appearance. He wore a blue denim jacket, pink shirt and blue jeans.

The investigation is ongoing.

Nearly one in three pedestrians is distracted by a mobile device while crossing a busy street, and texting appears to be the most distracting and potentially most dangerous activity, according to a new study.

The study, published Wednesday in the journal Injury Prevention, looked at pedestrians crossing 20 busy intersections in Seattle in the summer of 2012. It concluded that nearly one out of three pedestrians was engaged in some distracting activity, including taking on the phone, listening to music, talking with others, or dealing with children or pets.

Pedestrians who were texting took, on average, 2 seconds longer to cross busy streets and were less likely to pay attention to traffic while doing it.

Distracted drivers took the lives of more than 3,000 people in 2010, according to the National Traffic Highway Safety Administration, which has an ongoing initiative related to the issue. Cell phone use was reported in 18 percent of all distraction-related fatalities, according to the NTHSA.

State legislatures have taken notice.

The authors of the distracted pedestrian study recommend studying intervention efforts to reduce the risk of pedestrian injury. They suggest an approach similar to the "don't drink and drive" campaign.

The evaluation documents are working drafts that state the superintendant can receive incentives worth up to $200,000 if certain performance goals are met.

The Dallas ISD Board Policy documents provide additional information on the evaluation process.

Parents, teachers and community members can express thoughts to the district about the plan.

AMR Plans to Cut Jobs at Maintenance Base

Dozens of workers at American Airlines maintenance base at Alliance Airport are losing their jobs Friday.

American Airlines says starting Friday 252 workers are being laid off and over the next few weeks about 700 employees are transferring within the company. The airline said 230 took an early retirement option.

Employees said they're being called in three people at a time to get their final paperwork. 
They've known about the cuts about a year, but it doesn't make their last day on the job any easier.

"The company elected to let this go, in my opinion, for greed," said maintenance worker Dennis Robinson.

Robinson is one of the victims of American Airlines bankruptcy.  He's thankful he's already found another job, but frustrated by American Airlines CEO/President Tom Horton's lack of a send-off.

"Mr. Horton, I say, it speaks highly of his character, not even to come out here and speak to us," said Robinson.

American plans to shut down the maintenance and engineering base as early as March.  A company spokesman said there will be some work done on components, not aircraft, into part of next year.

They'll be making room at the DFW hangar, so American can make its final departure from Alliance Airport.  The engine shop and test cell will continue to operate under the bankruptcy plan.

"To the employees, this is totally unfair.  Management took so much and has given so little back to employees," said maintenance worker Helen Petty.

Initially the company thought the cuts would be even more painful, but around 700 employees have decided to stay with American and relocate.  It's not a welcomed move for Alicia Besette's family.  Her husband, who is a mechanic, is now Miami-bound.

"We've just been run through the ringer, financially speaking, emotionally speaking, you name it.  It's enough.  They talk about shared sacrifice? The only ones I see making the sacrifice thus far are us, the lower end, the mechanics, spouses, children," said Besette.

Aircraft mechanic and Arlington-native Dave Warden is leaving a company he's been dedicated to more than a decade. 

"After 13 years, it's a little emotional.  We're going to be okay," said Warden.

American Airlines was the first tenant at Alliance Airport 23 years ago. The company makes up about three percent of the workforce at the location.

Neighboring businesses expect to feel the pain from the loss.

"It would really hurt our business, and yes, we talk to our customers about it and they're very, like they don't know what's going to happen or anything," said Betty Yeary, manager at Snooty Pig Restaurant. "So we're all concerned about it."

The Chamber of Commerce tells NBC 5 that half a dozen companies have already looked at possibly moving into the 1.6 million square foot facility.

A lot of work done at the Alliance location will be outsourced to other companies.

Two Big Dallas Jewelry Holdups in Week

Dallas police are investigating two big jewelry holdups in hotel parking lots in broad daylight.

The latest armed robbery happened at about 3:30 p.m. Wednesday at the Hilton Anatole on Stemmons Freeway at Market Center. The thieves took $700,000 in gems, a computer and a cellphone from the victim, who worked for German company Wild & Petsch GmbH, according to a police report.

According to its website, the firm cuts and finishes fine gemstones for jewelers and goldsmiths.

The first robbery occurred at about 8 a.m. on Nov. 28 at the Hampton Inn on Composite Drive, just off the Stemmons Freeway at Walnut Hill Lane. Thieves stole about $55,000 in jewelry mountings, along with various personal items from the victim, who is from Hong Kong.

The Anatole is directly across the Stemmons Freeway from the Dallas Market Center.

DMC spokeswoman Margaret Hite said the center includes international jewelry wholesalers but that security determined that the Anatole victim was not a DMC visitor.

Danny Defenbaugh, a retired Dallas FBI special agent in charge, said the FBI typically participates in investigations that involve international or interstate commerce, at least by sharing intelligence information with local police.

Defenbaugh said large jewelry robberies often involve out-of-town thieves who have information about the victim.

"Particularly, there's gangs from South America who actually pick out and target the individual and will follow them a great distance until they see their opportunity, actually the higher percentage of which is in parking lots," he said.

Defenbaugh now works as a private investigator but also provide security advice to companies that deal in international commerce.

"There's certain things you can do to make someone look at you and realize, 'Here's an easy target," he said.

It is not clear if both of the Dallas robberies are related, but Defenbaugh said international jewel thieves may chose to travel when they know more than one target will be in a location.

"Many times, you're going to have a certain type of gang activity -- again, where their intelligence is almost as good as law enforcement's -- many times to where they're going to realize certain shipments are going to be coming in at a certain time. Then they're going to be aware of what to look for in a target," he said.

Dallas police declined comment on the cases Thursday.

Messages left at both hotels were not returned.

A telephone number listed online for a U.S. representative of the German gemstone company was disconnected.

Man With Gun Shot by Dallas Police

Dallas police said a man with a gun walking down Castlefield Drive Thursday afternoon didn't comply with orders to drop his weapon and instead raised the gun at officers, so they were forced to shoot the man.

Dallas police officers fatally shot a man who was walking with a shotgun in East Dallas near Pleasant Grove on Thursday afternoon.

Police said a witness told responding officers that a man was walking in the 9500 block of Castlefield Drive with a weapon at about 3:40 p.m. Sgt. Warren Mitchell said the man was carrying a shotgun.

The officers saw Robert Williams, 37, and told him to drop the shotgun. The officers opened fire when the man continued to walk toward them while raising the weapon, police said.

Williams was taken to a Dallas hospital, where he later died.

No police officers were injured.

Roughly two dozen officers were in the area shortly after the shooting, and a home was cordoned off with police tape. Some clothes, including a jacket and shoes, were in the street.

Neighbors told NBC 5 that they heard gunshots and saw a man walking down the street with what appeared to be a long gun such as a rifle or shotgun.

Dallas police have released surveillance footage of thieves stealing expensive, heavy planters off a front porch in Preston Hollow.

Last week, Highland Park police reported several strange thefts -- large planters costing hundreds of dollars each stolen from at least three homes.

Dallas police said Thursday that the bizarre crime spree appears to have continued in Preston Hollow, where three homes were hit overnight.

One of the thefts was caught on surveillance cameras at Erin and Andrew Hillman's house.

"I heard some noises out in the front," Erin Hillman said. "I thought maybe it was a squirrel. Then I heard the noise more, and I see some men with their car pulled up into my front, and they are loading something."

The Hillmans turned the video over to Dallas police. It shows three men get out of a vehicle, load the heavy planters into the back of a white sport utility vehicle and take off.

The couple said the stolen antique cast iron urns with spiral trees were worth $5,000.

"I hope they find these guys and keep them from stealing people's plants and invading their house," Andrew Hillman said.

"I feel violated," Erin Hillman said. "I know it's only plants this time, but it makes me uncomfortable."

According to Dallas police reports, three homes in the neighborhood were hit, including one on nearby Tulip Drive.

Highland Park was hit last week, when at least six large pots stolen.

The Hillmans said they believe the thieves were driving a white Suzuki Samurai or similar vehicle. People in Highland Park also reported seeing a white SUV on the night their planters disappeared.

Supreme Court Taking Slow-Go Approach on Gay Marriage

The U.S. Supreme Court will decide what it wants to do with a stack of cases filling its in-box on the subject of same-sex marriage as soon as Friday. Just don't expect a final up-or-down vote on the issue anytime soon.

The Supreme Court is in the process of deciding what cases it will rule on in the next year. Ten same-sex marriage cases are possibilities, including a challenge to California's ban on gay marriage and a number of disputes over the federal Defense of Marriage Act.

The issue has become politically and socially fraught, and the court doesn't appear to be taking this decision lightly. It has deferred its announcement in recent days, but it can't put it off much longer, experts said.

"It's hard to look the other way," University of Chicago law professor Geoffrey Stone said.

The cases land in front of the Supreme Court as Americans seem to be growing slowly more accepting of same-sex marriage. A variety of public opinion polls taken over the last decade illustrate that shift.

During that time, the number of states where gay marriage is legal has grown to nine (in addition to the District of Columbia), the most recent burst coming on Election Day this year, when voters in Maine, Maryland and Washington endorsed it. Five more states allow civil unions, a legal step short of marriage. Three states -- including California -- permit domestic partnerships. The rest of the country bans gay marriage.

In May, President Barack Obama said his feelings on the issue had evolved to the point that he was comfortable with same-sex marriage.

Maryland and Washington began issuing marriage licenses on Thursday.

"That these issues exist at all is because public attitudes about homosexuality have changed dramatically," said Stone, a constitutional scholar and author. "Attitudes have evolved about the meaning of equality over time, just as they did with separate but equal (the invalidated legal doctrine that justified racial segregation) and with women."

The court has a range of choices, from sidestepping the issue entirely by choosing not to hear any of the cases to tackling the heart of the issue: whether same-sex marriage should be legal under the constitution.

But legal experts expect the court to land somewhere in the middle. The Supreme Court typically does not run ahead of changes in social norms, legal experts say. That is why it is expected to take up the issue in a way that avoids making too broad an impact.

The court could announce which gay marriage cases -- if any -- it will hear during the upcoming term on Friday.

There are two types of cases that the high court is considering. Most are related to the 1996 Defense of Marriage Act, a federal law that defined marriage as between a man and a woman. That legislation prohibits same-sex couples in states that have legalized gay marriage from an array of federal benefits, including tax deductions, Social Security survivor benefits and federal employee health insurance.

Across the country, challenges have arisen from people who have been denied assistance that they would have had access to if they were in a heterosexual union. They charge that the exclusion violates their constitutional rights of equal protection, and several lower courts have ruled in their favor.

Under President Obama, the Justice Department has stopped defending DOMA in court, and the Republican-led House of Representatives has taken up the fight.

The Supreme Court is widely expected to take up at least one of those cases, because it rarely passes on considering decisions that have overturned federal law.

California's Proposition 8 is another situation. That measure, banning same-sex marriages, was passed by voters in 2008 in response to a state Supreme Court ruling that legalized gay marriage. A federal judge struck down Proposition 8, saying it violated the constitution's Equal Protection Clause. The 9th U.S. Circuit Court of Appeals upheld that decision, but under narrower grounds, saying the state could not take from gay couples a right that they had already been granted.

Stone believes the high court will take up at least one case and rule in a way that strikes down DOMA and/or Proposition 8 without addressing the broader legality of same-sex marriage itself.

"This is an inflammatory issue, and a way of dipping one's toe in the water," Stone said.

He and many other Supreme Court observers see a split decision, with Justice Anthony Kennedy casting a swing fifth vote in favor of same-sex couples.

Under that scenario, the much larger issue -- whether it is discriminatory to bar gays and lesbians from getting married -- will be put off, most likely to a different Supreme Court.

Lisa Soronen, executive director of the State & Local Legal Center, which represents state and local governments in Washington, predicted that the Supreme Court would pass on Proposition 8, allowing the lower court's ruling to stand. If that happens, gay marriage would become legal in California almost immediately.

But the DOMA battle is too important to ignore, she added.

If the court does not take up any DOMA cases, then the stack of challenges will continue to grow, and rulings from lower courts will create a "weird" situation where federal law applies in some places and not in others, Soronen said.

She sees those cases through the prism of state's rights: historically, the federal government has butted out of family law matters.

"This isn't a thumbs up or thumbs down on same sex marriage; it's about the federal government limiting who can get married," Soronen said.

That narrow sort of view will likely guide the Supreme Court, she said.

David Axelrod has lost his signature mustache — for a good cause.

President Barack Obama's senior strategist had his trademark feature shaved off on MSNBC's "Morning Joe" on Friday, in an appearance also broadcast on the "Today" show.

But while Axelrod is now a few whiskers poorer, the epilepsy research non-profit his wife runs is now more than $1 million richer.

"How are we feeling, David?" Joe Scarborough, host of "Morning Joe," asked him on the set of the political talk show.

"Faint," Axelrod said from his seat in a barber's chair, with his wife Susan by his side. "I was up all night, to be honest with you," he added.

After 40 years with his trademark 'stache, Axelrod had promised to shave it off if Susan Axelrod's organization Citizens United for Research in Epilepsy — a condition the couple's oldest child suffers from — could raise more than $1 million.

By Friday morning, the group had raised $1,049,797, according to the campaign's website.

Initially, Axelrod had made a bet with Scarborough over his facial hair concerning the presidential election, not epilepsy, promising to shave it off if Obama lost three key states. Scarborough was supposed to grow a mustache if he lost.

Axelrod won that bet, but public interest in the possibility of his bare face had already been piqued. Scarborough skirted his end of the bet, and the threat of having to grow a mustache, by offering to donate $10,000 to epilepsy research if Axelrod shaved his anyway.

The epilepsy fundraising drive reflected that interest. Donald Trump donated $100,000, while Obama, Carole King and 25,885 others also donated, according to Axelrod and his website. 

Trump, for one, said he felt his money was well spent and complimented Axelrod's new look, saying that it reminded him of his own father's.

"I think he looks great," Trump said in a phone call into "Morning Joe."

Dallas police are investigating a double shooting at a nightclub early Friday morning.

Police say off-duty officers were working near Club Kalua when they heard gunshots at about 3:20 a.m. 

The officers found two men, both shot, in the nightclub's parking lot along Harry Hines Boulevard, near Northwest Highway.

One man was shot in the head, another in the arm. Both injuries are serious, police said. The men were taken to Parkland Hospital.

Two men were seen running from the location in a silver car. Nearby police spotted a car that matched the description and tried pulling the car over, but it took off, police said.

The car sped down a dead end road, police said. The car couldn't stop before smashing into a building.

Both men inside the vehicle were arrested.

Police are still investigating why the men were shot.
